1. Parties and Scope
These Terms of Use regulate the terms between RND Otomotiv Turizm Ticaret Limited Şirketi, which provides vehicle rental services under the DefCar Rental brand, and customers who make reservations through the website or use vehicle rental services.

The specific terms concerning the vehicle rental service are determined by the reservation confirmation and the rental agreement concluded between the parties. The consumer's statutory rights are reserved.
2. Scope of the Service
DefCar Rental provides vehicle reservation and rental services subject to vehicle availability and rental conditions.
The vehicle group, rental period, pick-up and return locations, mileage conditions, insurance and protection packages, and additional services are specified during the reservation or in the rental agreement.
The vehicle, price and availability information displayed on the website does not mean that the reservation has been definitively confirmed.
3. Reservation and Confirmation
Reservation requests may be made through the website or DefCar Rental's communication channels.
The reservation becomes final upon confirmation by DefCar Rental and completion of any required payment or other conditions.
A reservation may not be confirmed if the vehicle is unavailable, incomplete or incorrect information is provided, payment conditions are not met, or rental criteria are not satisfied.
The details of the confirmed reservation are notified to the customer through the relevant communication channel.
4. Driver and Vehicle Delivery Conditions
At the time of vehicle delivery, the renter must present the following documents:
Valid identification or passport and driver's license.
A valid credit card issued in the name of the renter who made the reservation, enabled for online transactions and bearing a CVV/CVC security code.
For Turkish citizens residing abroad and foreign nationals, a passport and a document or record showing entry information into Türkiye.
Depending on the vehicle group, 2 separate credit cards issued in the renter's name may be required. The minimum driver age and driver's license duration requirements are specified in the reservation conditions.
The vehicle will not be delivered in the event of missing documents, failure of the credit card to meet the required conditions, or failure to satisfy the rental criteria. In this case, the conditions for cancellation and refund of the reservation and statutory rights shall apply.
The vehicle may only be driven by drivers approved by DefCar Rental. The vehicle's fuel, mileage, existing damage and equipment information may be recorded at the time of delivery.
5. Prices, Payment and Deposit
Rental fees are determined according to the vehicle group, rental period, pick-up and return locations, selected additional services and applicable pricing conditions.
The total rental price, included services, taxes and any additional fees are notified to the customer during the reservation.
For rental transactions, a deposit or pre-authorization may be taken from the credit card depending on the vehicle group and reservation conditions.
The deposit amount, collection method and refund conditions are specified during the reservation or in the rental agreement.
Additional fees for fuel shortages, excess mileage, late return, traffic fines, damage and other charges may be collected in accordance with the contract conditions previously notified and the relevant legislation.
6. Vehicle Use Rules
The customer is obliged to use the rented vehicle in accordance with traffic rules, the rental agreement and the vehicle's technical specifications.
The vehicle;
May not be driven by unauthorized persons.
May not be used in races, speed trials or dangerous driving activities.
May not be used in unlawful activities.
May not be loaded beyond its technical capacity.
May not be used for commercial transportation without DefCar Rental's permission.
May not be taken outside Türkiye without prior written permission.
The customer is responsible for safeguarding the vehicle keys, documents and equipment.
7. Fuel and Mileage
The vehicle must be returned with the fuel level recorded at the time of delivery.
In the event that it is returned with insufficient fuel, the pricing specified in the rental agreement shall apply.
If there is a mileage limit within the scope of the rental, this limit and the excess mileage fee are specified during the reservation.
8. Vehicle Tracking and Security
GPS tracking systems may be used in vehicles rented out by DefCar Rental to ensure vehicle security and prevent theft and unauthorized use.
Vehicle location and usage information may be accessed through the vehicle tracking service.

9. Damage, Accident and Breakdown
If damage, an accident, breakdown or a situation affecting safety occurs in the vehicle during the rental period, the customer must inform DefCar Rental without delay.
In the event of an accident, the necessary safety measures must be taken, the law enforcement authorities must be contacted when necessary, and the relevant reports must be obtained.
Repairs carried out without DefCar Rental's approval, except for mandatory and reasonable emergency interventions, do not automatically create a payment obligation for the company.
Liability for damage and expenses is assessed in accordance with the state of fault, insurance coverage, the rental agreement and the relevant legislation.
10. Insurance and Protection Packages
The scope, fees, deductibles and exclusions of insurance and optional protection packages relating to rented vehicles are specified during the reservation or in the rental agreement.
Protection packages are valid only within the scope and conditions stated.
Liabilities that may arise due to use contrary to the agreement or traffic rules are assessed according to the relevant insurance and protection conditions.
11. Traffic Fines and Toll Fees
Traffic fines arising from the use of the vehicle during the rental period, HGS toll fees, parking fees and similar expenses may be charged to the customer within the framework of the rental agreement and the relevant legislation.
Amounts paid by DefCar Rental and processing fees specified in advance in the agreement may be collected from the customer.
The customer's statutory rights to object to administrative fines are reserved.
12. Vehicle Return and Delay
The vehicle must be returned at the date, time and return location specified in the rental agreement.
At the time of return, the vehicle's fuel level, mileage, equipment and damage condition may be checked.
Prior approval from DefCar Rental must be obtained to change the return date, time or location.
Fees that may apply due to late return, return at a different location or incomplete delivery are determined according to the rental conditions previously notified to the customer.
13. Reservation Cancellations and Changes
Reservation cancellation and change requests may be submitted through DefCar Rental's communication channels.
Cancellation, date change, no-show and early return conditions are applied according to the terms notified to the customer during the reservation.
Returning the vehicle before the agreed rental period does not mean that the price of the unused rental period will automatically be refunded.
The rental agreement and the applicable legislation shall form the basis for refund or deduction transactions.
The consumer's statutory rights are reserved.
14. Responsibilities of the Parties
DefCar Rental is obliged to perform the services it has undertaken within the scope of the confirmed reservation and rental agreement.
The customer is legally responsible, to the extent applicable, for using the vehicle in accordance with the agreement, making the necessary notifications and any damage arising from the customer's own fault.
The rights and obligations of the parties are assessed within the scope of the rental agreement and the applicable legislation.
15. Protection of Personal Data
DefCar Rental processes personal data in accordance with the relevant legislation within the scope of its reservation and vehicle rental activities.
Detailed information regarding the processing of personal data is provided in the KVKK Clarification Text, while data security practices are explained in the Privacy Policy.
16. Disputes and Applicable Law
The laws of the Republic of Türkiye shall apply to disputes arising from these Terms of Use and vehicle rental transactions.
For consumer transactions, the provisions of the Consumer Protection Law No. 6502 and the relevant legislation shall apply.
For the resolution of disputes, consumer arbitration committees, consumer courts or other competent authorities having jurisdiction under the relevant legislation may be applied to.
